What is gambling?

According to § 284 of the Criminal Code, the public organization of gambling without official authorization is not permitted. Examples of gambling include: games in casinos such as roulette, baccarat, blackjack, poker, etc., as well as lotteries, state lotteries (6 out of 49), etc. In addition to the basic requirement that gambling be offered at all, two further conditions must be met:

  1. Direct or indirect wager.
  2. Distribution of potential winnings in a non-negligible amount.

Law on the Licensing of Public Casinos in Berlin:

In the highly federalized system of the Federal Republic of Germany, the granting of licenses to operate public gambling establishments is a matter for the states. For this reason, all states have enacted laws governing the operation of casinos. In the State of Berlin, this is regulated by the Act on the Licensing of Public Casinos. Among other things, this Act regulates the number of casinos in Berlin—namely, two—the granting of licenses and their duration, taxes such as casino levies and additional levies, and the fundamental obligations of the casino operator.

The Gaming Regulations of Spielbank Berlin:

Section § 10 of the Act on the Licensing of Public Casinos also stipulates that the supervisory authority must issue gaming regulations to govern casino operations. Among other things, these regulations cover:

  • Permitted games and rules of play
  • Permitted gaming hours and opening hours
  • Admission to the casino
  • Any gaming bans
  • The casino’s duty of supervision
