General Terms and Conditions (GTC) for “Dine & Gamble”

  1. Scope of Application

Spielbank Berlin GmbH & Co. KG (hereinafter “SBB” or “Spielbank”) offers guests of the casino, as part of the Dine & Gamble program (hereinafter the “Dine & Gamble Program”), a combination of an unforgettable experience, fine dining, and the thrill of gambling. As part of the Dine & Gamble Offer, SBB guests can purchase various casino packages (hereinafter “Packages”) or gift certificates (hereinafter simply “Gift Certificates”) (hereinafter collectively referred to as the “Dine & Gamble Offer”). Details of the offer, including the applicable prices, can be found at www.spielbank-berlin.de.

The “Packages” are an offer that allows guests to book certain dining options and other casino or merchandise offerings – such as casino merchandise, guided tours of the casino’s Potsdamer Platz location, or game instructions – in advance through SBB. This also includes reserving casino chips, which are handed to the guest by casino staff on the day of the visit. Gift certificates are vouchers for SBB dining services that can be redeemed at any casino location at any time.

These General Terms and Conditions also apply to gift certificates for dining services that the casino gives to its guests as gifts. The same applies to gift certificates for dining services, free admission, and merchandise items that are given to guests as gifts.

2. Conclusion of the Contract

For the “Dine & Gamble” offer, the contract between the guest and SBB is concluded when SBB sends the order confirmation to the address provided by the guest, the guest accepts it within the specified time frame, and the invoice amount is paid. A further prerequisite is that the guest is at least 18 years old, is not subject to a ban from the premises, and is not subject to a gambling suspension. The time-specific reservation is therefore binding. SBB is entitled to engage a third party to fulfill its obligations under the contract concluded with the guest.

  1. Privacy Policy

The guest agrees that all order data pertaining to him or her may be stored by SBB as part of its electronic data processing for the purpose of fulfilling the contract concluded with the guest.   1. Prices

The prices applicable to each Diner & Gamble offer can be found at www-spielbank-berlin.de. The prices include the applicable statutory value-added tax.

  1. Booking and Reservation

Booking requests for the “Dine & Gamble” offer are made online via the website www-spielbank-berlin.de. The booking request must be submitted at least one week (7 days) in advance if it is for a specific date. The specific Dine & Gamble package requested in the booking is provisionally reserved – subject to the guest’s timely payment – upon receipt of the order confirmation sent by SBB to the guest. Gift certificates as part of the Dine & Gamble package are excluded from this provision. Gift certificates can also be purchased directly at the casino’s locations without a booking request.

  1. Purchase and Payment

SBB is entitled to require full prepayment for the booked “Dine & Gamble” package. Gift certificates must be paid for immediately upon purchase at the respective casino location. The guest will receive an invoice for this.

The total amount of the invoice must be paid by bank transfer to SBB using the bank account information provided on the invoice and within the payment deadline specified on the invoice.

  1. Gift certificates

Gift certificates are issued by SBB upon payment and either handed directly to the guest or sent to them (by mail or email).

Gift certificates may be redeemed within a period of 3 years, through December 31 of the third year following issuance, unless a different expiration date is noted on the certificate. Once this period has expired, the guest’s right to redeem the gift certificate expires.

Cash redemption or partial redemption of gift certificates is not permitted. Gift certificates may only be redeemed at the casino’s locations.

  1. Commercial Resale

Commercial resale of gift certificates by the guest or third parties is prohibited. Commercial resale occurs, in particular, when a sale is made with the intent to make a profit or on a regular or serial basis, including sales via online marketplaces or ticket/voucher platforms.

The casino is entitled to block vouchers that have been sold in violation of this prohibition; claims arising from such transactions may be asserted exclusively against the respective seller, but not against the casino. In the event of violations, the casino may, in accordance with statutory provisions, demand, in particular, cessation and removal, as well as claim damages; further rights remain unaffected. The casino reserves the right to assert claims arising from unjust enrichment (return of what was obtained through the violation). The casino is entitled to take action against unauthorized offers on platforms and to demand their removal; the guest agrees to delete such offers immediately upon request.

  1. Cancellation by the Guest

Unless otherwise specified in the order confirmation, the guest may cancel the contract for the “Dine & Gamble” offer up to 7 days before the booked date. In this case, SBB will refund 100% of any advance payments made by the guest. Gift certificates are excluded from this policy. Cancellation must be made in writing via email to SBB at the following address: guest-relation@spielbank-berlin.de

Once the cancellation period has expired, any advance payment made by the guest can no longer be refunded. Any advance payment made by the guest will also be forfeited if the guest fails to attend or arrives late for a booked Dine & Gamble offer without prior cancellation, and SBB is under no obligation to offer the guest an alternative date. A delay in this context is defined as the guest arriving more than 15 minutes late.

  1. Changes to the Number of Participants in Groups

“Packages” with a binding number of participants cannot be changed retroactively with regard to the number of participants, unless SBB agrees to such a change in writing. If the actual number of participants is lower than the number booked, billing will be based on the agreed-upon total price; in particular, the guest is not entitled to a partial refund. Section 9 remains unaffected.

  1. Changes to Services by the Provider

SBB reserves the right to make changes to the services contractually owed in connection with the Dine & Gamble offer, provided that such changes are necessary for organizational or unforeseeable reasons and are not unreasonable for the guest.

  1. Withdrawal from the Contract by SBB

If SBB is unable to fulfill the contract for reasons beyond its control, SBB is entitled to withdraw from the contract.

The right to withdraw applies in particular in cases of force majeure, strikes, or other events unforeseeable by SBB and for which SBB is not responsible, which make it unreasonable to expect SBB to fulfill the contract.

In this case, the invoice amount will be refunded in full, provided the guest has already made an advance payment. No further claims may be asserted.

  1. Terms and Conditions of Participation

Admission to the casino and participation in the “Dine & Gamble” program are subject to compliance with the casino’s current house rules and gaming regulations, which can be found at www.spielbank-berlin/haus-und-spielordnung, as well as applicable laws.

The minimum age for participating in the Dine & Gamble program is 18. A valid form of identification is required to enter the respective casino location.

  1. Liability

SBB is fully liable, in accordance with statutory provisions, for damage to life, body, or health resulting from an intentional or negligent breach of duty by SBB, its representatives, or its agents. For damages caused by simple negligence, SBB is liable within the scope of statutory provisions only to the extent that such negligence concerns a breach of SBB’s contractual obligations whose fulfillment is of particular importance for achieving the purpose of the contract. In all other respects, SBB is liable within the scope of statutory provisions only for intentional and grossly negligent breaches of duty.

  1. Final Provisions

Any amendments or additions to the contract, the acceptance of the application, or these General Terms and Conditions may only be made in writing or in text form. This also applies to this written form requirement. The place of performance for the booked “Dine & Gamble” offer is the casino located at Marlene-Dietrich-Platz 1, Berlin. This does not apply to purchased gift certificates, which can be redeemed at all of the casino’s locations in Berlin. The laws of the Federal Republic of Germany apply. Should any provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
